In terms of the issue of sexual stimulation the court finds that the enterprise was aware of the requirements of the viewer in terms of increased nudity. They even contained an understanding that some of their activity might be considered illegal. They knew where the customer would place value (i.e. on the nudity of the boys). The court noted as the client base expanded so did the amount of nudity. Azov Films had a sizeable group of viewers in 92 different countries. The increasingly large revenues the court reasoned was as a response of the many customers for more nudity, including a focus below the waist material. The court concluded beyond a reasonable doubt that given the element of the enterprise was profiting from the demand for increased nudity.
The prosecution relied on the viewing of more than 5,000 pages of way articles, of which most discussed the topics of child pornography and self-defined naturist films. While the exhibits were properly qualified, there were limits. The court agreed that Way:
While it is possible that there was some element of actually viewing images of actual children, and not just descriptions of what they might look like, the evidence was too limited and the State failed to prove that Way had a sexual interest in them. The Court accepted that Way was at least looking for images of real children. The prosecution suggested that a child for purposes of the statute could be someone under the age of 16 who is depicted naked, but the court pointed out that these videos were of adults wearing clothes and engaged in sporting activities. The prosecution suggested that a child under the age of 14 could be one who had appeared before the cameras, but there was no evidence that any of the films contained that. The court further pointed out that a child could appear in the films, but who were the child and who produced the films, and under what conditions, were unknown and unknowable. The court agreed that the evidence showed nothing more than Way viewing depictions of a naked body, and nothing more than Way looking for images of children. The court found that Way had not engaged in sexual conduct with children.
